Terms of Service
The agreement between you and Answer Labs Inc. (doing business as Answerr) for use of the Answerr platform, AIQ™ assessments and related services.
Last updated: November 2, 2026
Supersedes: Terms of Service dated August 7, 2026
Answer Labs Inc., doing business as Answerr, 131 Continental Drive, Suite 305, Newark, DE 19713, New Castle County, Delaware, United States.
0. Introduction and Scope
Welcome to Answerr.
Answerr is an AI capability platform that helps individuals and organizations understand, measure, verify and develop how people work with artificial intelligence.
These Terms of Service (“Terms”) govern access to and use of the Answerr platform, websites, applications, AI capability challenges, organizational workspaces, AIQ™ credentials, integrations, APIs and related services (collectively, the “Service”).
These Terms form a legally binding agreement between Answer Labs Inc. (“Answerr,” “we,” “us,” or “our”) and the person or organization accessing or using the Service (“you” or “your”).
By creating an account, accepting an invitation, purchasing a subscription, clicking an acceptance button, or accessing the Service, you agree to these Terms.
If you use Answerr on behalf of a company or other organization, you represent that you are authorized to act for that organization. If you do not have that authority, your acceptance applies only to you personally and does not bind the organization.
If you do not agree to these Terms, do not use the Service.
0.1 Who These Terms Apply To
Organizations. Companies, employers, staffing firms, recruitment agencies, educational institutions and other organizations that subscribe to or obtain authorized access to Answerr. Organizations may purchase services through online registration, self-service checkout, an Order Form, a Master Services Agreement, or another written commercial agreement.
Authorized Users. Individuals who access Answerr through an Organization, including administrators, recruiters, hiring managers, employees, faculty members, students, contractors and other authorized personnel.
Candidates and Participants. Individuals invited to complete an AI capability challenge or participate in an evaluation, workforce development program, or other organization-sponsored activity.
Individual Users. People who independently create an Answerr account, including users of free plans, trials, paid subscriptions and personal AIQ™ credentialing services.
An individual may belong to more than one category. For example, someone may maintain a personal Answerr account while separately completing a hiring challenge for an employer.
0.2 Organization Agreements
Where an Organization has entered into a signed Master Services Agreement, Order Form, or Data Processing Addendum with Answerr, those agreements supplement these Terms.
Unless the applicable agreements specify another priority, conflicts will be resolved in the following order:
- The applicable Order Form for commercial and service-specific matters.
- The Master Services Agreement.
- The Data Processing Addendum for personal-data processing matters.
- These Terms.
An applicable Data Processing Addendum controls over inconsistent provisions concerning the processing and protection of personal data, regardless of the general order above.
An Organization’s separate agreement with Answerr does not eliminate an individual user’s obligations concerning account security, challenge integrity, lawful conduct and responsible use.
Our Privacy Policy describes how we process personal information. Nothing in these Terms limits privacy rights that cannot lawfully be waived.

2. Description of the Service
Answerr provides technology for understanding, measuring, verifying and developing human capability in AI-assisted work.
Depending on the selected subscription, configuration and product availability, the Service may include the following.
2.1 Hiring and Recruiting
Answerr enables organizations to invite job candidates to participate in AI capability challenges that demonstrate how they approach problems, evaluate information, exercise judgment and work with artificial intelligence.
The Service may generate Capability Reports and related evidence to support an organization’s evaluation process.
Answerr provides evaluation technology and supporting information. It does not select candidates, make hiring decisions, or determine employment eligibility on behalf of an employer.
2.2 Workforce Capability and Development
Organizations may use Answerr to understand and develop the AI capabilities of their employees or other authorized participants.
Available functionality may include capability baselines, team-level reporting, individual development insights, repeated Challenges, progress measurement and organizational analytics.
2.3 Individual AI Capability
Individuals may use Answerr to complete personal AI capability challenges, understand their demonstrated capabilities, measure development and obtain eligible AIQ™ credentials.
The availability of particular results, reports, credential levels, downloads, or verification features depends on the applicable plan.
2.4 Credentialing
Where enabled, Answerr may issue, manage, display and verify AIQ™ credentials based on qualifying activity or evaluation results.
2.5 Integrations and APIs
The Service may connect with supported applicant tracking systems, learning management systems, enterprise identity providers and other third-party applications.
Specific integrations, APIs, synchronization features and administrative capabilities may be available only on particular plans or through separate agreements.
2.6 Changes to the Service
We may improve, replace, introduce, or discontinue features as our technology and products develop.
We may also change supported AI models, integrations, methods and technical infrastructure.
Where a change materially reduces a core paid feature during an existing paid subscription term, we will provide reasonable advance notice when practicable and offer any remedy required by the applicable agreement or law.
No particular product feature is guaranteed unless expressly included in the customer’s purchased services or written agreement.
3. Eligibility, Accounts and Access
3.1 Minimum Age
You must be at least sixteen (16) years old to use Answerr, unless we have entered into a separate written agreement authorizing younger participants with appropriate safeguards and legally required consents.
The Service is not directed to children under thirteen (13).
Organizations must not provision users below the applicable age requirement without prior written authorization from Answerr.
3.2 Accurate Information
You agree to provide accurate account information and to keep it reasonably current.
Where identity information is requested for a Challenge or credential, you must provide accurate information and must not impersonate another person.
3.3 Account Security
You are responsible for protecting your login credentials and for activity conducted through your account, except to the extent attributable to Answerr’s breach or another circumstance for which you are not legally responsible.
You must not knowingly share your account with an unauthorized person.
If you suspect unauthorized account access, notify support@answerr.ai promptly with “Security” in the subject line.
3.4 Organization Administration
Organizations are responsible for managing authorized access within their workspaces, including user roles, administrative permissions, invitation settings and timely removal of access when appropriate.
Administrators may be able to view activity, usage information, Challenge results and other data within the scope of their organization’s subscription and permissions.
Organizations must ensure that administrative access and data visibility are lawful and appropriately communicated to affected users.
3.5 Personal and Organization Accounts
A person may maintain an independent personal account and separately participate in an organization-sponsored activity.
An Organization’s authorization to access its own workspace or sponsored reports does not automatically grant it access to an individual’s unrelated personal activity, private conversations, independently obtained credentials, or data associated with another organization.
Where accounts or workspaces are linked, the scope of sharing must be disclosed through the relevant product experience or applicable agreement.
3.6 Access Restrictions
We may require additional verification or restrict access where necessary to prevent fraud, protect account security, comply with law, or preserve Challenge integrity.
4. Subscriptions, Fees and Billing
4.1 Available Plans
Answerr may offer free, trial, individual, hiring, workforce development, enterprise and other subscriptions.
Each plan provides the features, usage allowances and service limits identified at purchase or in the applicable agreement.
4.2 Organization Subscriptions
Organization subscriptions may be based on candidate volume, workforce participants, active users, licenses, service capacity, or another agreed measurement.
The relevant Order Form or online checkout specifies the purchased plan, subscription period, fees and applicable limits.
Organizations may not exceed purchased allowances except where additional usage is permitted under their agreement or purchased through an approved upgrade.
4.3 Candidate Allowances
Hiring plans may include a specified number of candidate evaluations or other usage units.
The purchase documentation or in-product subscription terms will state when an allowance is consumed, how abandoned or incomplete Challenges are treated and whether retakes require additional capacity.
Customer administrators are responsible for monitoring usage and managing invitations within their purchased allocation.
Additional usage may require an upgrade or additional purchase. Answerr will not impose undisclosed overage charges.
Unless expressly stated otherwise, unused allowances do not carry forward to subsequent subscription periods and cannot be exchanged for cash.
4.4 Workforce Licenses
Workforce plans may limit the number of employees, participants, active users, or other covered individuals.
Any rules concerning license assignment, reassignment, minimum commitment periods, or organization-level reporting will be specified in the applicable plan or Order Form.
4.5 Individual Subscriptions
Individual subscriptions may provide access to additional Challenges, detailed reports, AIQ™ credential features, downloadable records, or other premium capabilities.
Plan benefits and limitations are displayed before purchase.
4.6 Automatic Renewal
Subscriptions identified as automatically renewing will renew at the applicable billing interval until canceled.
The renewal period, pricing and cancellation process will be disclosed at purchase.
Customers may cancel through the available account-management process or by contacting support@answerr.ai.
Unless applicable law or an agreement provides otherwise, cancellation stops future renewals but does not terminate access before the end of the paid billing period.
For subscriptions governed by a negotiated Order Form, the renewal and notice provisions in that agreement control.
4.7 Payment Terms
For negotiated organization subscriptions, payment obligations are governed by the applicable Order Form.
If the Order Form does not specify payment terms, invoices are payable within thirty (30) days, and annual subscription fees are invoiced in advance.
Fees exclude applicable taxes unless otherwise stated. Customers are responsible for taxes associated with their purchases, other than taxes imposed on Answerr’s net income.
4.8 Refunds
Except where required by law or expressly provided in a written agreement, subscription payments are non-refundable.
Answerr may consider refund requests involving billing errors, duplicate purchases, or other exceptional circumstances.
A user may request review of an initial individual subscription purchase within seventy-two (72) hours. Any discretionary refund will take account of the services already used and applicable consumer law.
This provision does not limit statutory cancellation or refund rights.
4.9 Price Changes
We may modify subscription prices, plan structures, or usage rates.
For existing automatically renewing subscriptions, price changes normally apply at the next renewal.
We will provide at least thirty (30) days’ notice of annual subscription price increases and fourteen (14) days’ notice for monthly subscription increases, unless a longer period is required by law.
Customers may cancel before the increased price takes effect.
4.10 Trials and Promotional Access
Free trials, pilots, discounts and promotional plans may have separate eligibility conditions, limitations, or expiration dates.
If a trial converts to a paid subscription, the conversion terms and charges will be disclosed before payment authorization.
4.11 Failed Payments and Disputes
We may suspend paid access for unresolved payment failures after providing notice and a reasonable opportunity to resolve the issue.
Customers should contact support@answerr.ai about billing errors. Nothing in these Terms restricts legally protected rights to dispute payment transactions.
5. Acceptable Use
You agree to use Answerr lawfully, responsibly and consistently with the rights of other users.
You must not:
- Use the Service for illegal, fraudulent, deceptive, discriminatory, or otherwise prohibited activities.
- Violate applicable employment, privacy, intellectual property, education, consumer protection, export control, or artificial intelligence laws.
- Attempt unauthorized access to accounts, systems, APIs, or information.
- Share account credentials or impersonate another person.
- Upload malware, interfere with Service operations, or compromise security.
- Circumvent access restrictions, subscription limits, usage controls, or security mechanisms.
- Reverse engineer or attempt to extract proprietary scoring methods, confidential Challenge materials, private model instructions, or other protected technology, except where permitted by applicable law.
- Copy, publish, sell, or distribute proprietary Challenge Content without authorization.
- Use unauthorized automation, scraping, or mass data extraction outside documented and approved interfaces.
- Use the Service or its protected content to build, train, or reproduce a competing evaluation or credentialing system without authorization, subject to applicable law and open-source license rights.
- Submit information you do not have the right to use or disclose.
- Use AI-generated information deceptively or without disclosure where disclosure is legally required.
- Attempt to identify individuals from aggregated or de-identified information.
- Distribute confidential candidate, employee, or customer reports to unauthorized recipients.
- Use the Service to discriminate unlawfully or to circumvent protections applicable to employment or other consequential decisions.
5.1 Restricted Data
Unless expressly authorized under a separate written agreement, you must not submit government-classified information, payment card data requiring PCI DSS safeguards, protected health information requiring a HIPAA-regulated service, or other categories of information requiring safeguards not supported by your subscription.
Answerr does not act as a HIPAA Business Associate unless a separate written Business Associate Agreement is in effect.
5.2 Enforcement
We may investigate suspected violations and take proportionate action, including warnings, restrictions, suspension, or termination.
Immediate suspension may occur where necessary to address an ongoing security incident, serious legal risk, fraudulent activity, or threat to Challenge integrity.
Where feasible, we will provide notice and an opportunity to correct less urgent violations.
6. AI Capability Challenges and Participation Integrity
The reliability of Answerr depends on participants demonstrating their own capabilities within the rules of each Challenge.
6.1 Participant Responsibilities
When completing a Challenge, you agree to:
- Complete the assigned activity yourself.
- Follow the applicable instructions and permitted-use rules.
- Use AI assistance where the Challenge allows or requires it.
- Avoid assistance from another person unless expressly authorized.
- Avoid unauthorized automation, scripts, answer-sharing services, or outside assistance.
- Not impersonate another participant.
- Not obtain, reproduce, or distribute confidential Challenge Content.
- Provide truthful identity information where verification is required.
6.2 Use of Artificial Intelligence
AI assistance is an intended part of many Answerr Challenges.
Using AI is not inherently misconduct.
Participants may use the AI tools permitted by the Challenge instructions. However, prohibited assistance, misrepresentation, or interference with evaluation procedures may affect the validity of a result.
6.3 Challenge Content
Challenge scenarios, scoring criteria, instructions and associated proprietary materials belong to Answerr or its licensors.
Participants may use these materials solely to complete the authorized Challenge.
You must not disclose restricted Challenge Content or use it to give another participant an unfair advantage.
6.4 Interruptions and Technical Problems
Technical failures, connectivity problems, accessibility barriers, or incomplete sessions may affect Challenge completion and results.
Participants should report problems promptly through the Service or to support@answerr.ai.
Where appropriate, Answerr may investigate technical issues and coordinate with the sponsoring organization concerning session restoration, retakes, or other remedies.
A retake is not automatically guaranteed.
6.5 Integrity Violations
Where credible evidence indicates material misconduct, Answerr may:
- Place a result under review.
- Invalidate an affected result.
- Restrict further participation.
- Suspend or revoke an associated AIQ™ credential.
- Notify the sponsoring organization of the integrity concern.
Answerr will not treat an automated integrity flag, by itself, as conclusive proof of misconduct.
Material integrity determinations involving individual participants will be subject to human review.
6.6 Appeals
A participant whose result has been invalidated or whose credential has been revoked may submit an appeal to support@answerr.ai with “Challenge Appeal” in the subject line.
Appeals should generally be submitted within thirty (30) days after notification.
We will acknowledge the appeal within five (5) business days and aim to provide a substantive response within thirty (30) days.
Appeals will be reviewed by someone other than the person responsible for the initial determination, where practicable.
Where the sponsoring organization is responsible for the disputed decision, we may refer the matter to that organization.
These procedures do not replace statutory data-correction, consumer-report dispute, accessibility, or other legally protected rights.
7. Hiring, Recruiting and Staffing Use
This section applies whenever Answerr is used in connection with employment-related evaluations or recruiting activities.
7.1 Purpose of Hiring Services
Answerr enables organizations to observe and evaluate how candidates work with AI through structured Challenges and related evidence.
Capability Reports may help employers understand demonstrated judgment, critical thinking, reasoning and other relevant capabilities.
Answerr supplies technology and evaluation information. It does not act as the employer, make final employment decisions, or guarantee the suitability of any candidate for a position.
7.2 Employer Responsibilities
Organizations using Answerr for hiring are responsible for:
- Determining whether a Challenge is appropriate for the relevant role.
- Ensuring that selection criteria are lawful and job-related where required.
- Providing legally required candidate notices and disclosures.
- Obtaining any required permissions or authorizations.
- Making reasonable accommodations available where required by law.
- Complying with applicable employment, anti-discrimination and automated decision-system requirements.
- Conducting any legally required impact assessments, bias audits, recordkeeping, or reporting.
- Making employment decisions through legally compliant procedures.
Answerr will provide commercially reasonable information and documentation concerning the Service to assist customers with applicable compliance requirements, subject to confidentiality and intellectual property protections.
7.3 Human Decision-Making
Capability Reports are intended to inform, rather than independently determine, employment decisions.
Organizations must not use Answerr results as the sole automated basis for a legally or similarly significant employment decision where such use is prohibited by law.
Customers must provide human oversight and meaningful review where required, including consideration of relevant context, limitations and any applicable accommodation or dispute process.
7.4 Candidate Notice
Before a candidate begins an employer-sponsored Challenge, Answerr or the sponsoring organization will provide information about the nature of the activity and the categories of information collected and shared.
The sponsoring organization remains responsible for any additional notices required by applicable employment law, including disclosures concerning automated evaluation tools and legally required advance notice periods.
7.5 Employer Access to Candidate Information
When a candidate participates in an organization-sponsored Challenge, the sponsoring organization may receive the resulting Capability Report and supporting information authorized for that Challenge.
Depending on the enabled features and disclosures, that information may include:
- Candidate identity and participation status.
- Submitted responses and work product.
- Relevant AI interaction records.
- Observed behavioral indicators.
- Dimension-level evaluation results.
- Reported strengths and development opportunities.
- Integrity or completion status.
- Other evidence disclosed as part of the Challenge.
The scope of access is governed by the relevant customer agreement, configured permissions, applicable law and candidate-facing disclosures.
7.6 Separation of Personal and Sponsored Data
An employer’s access to a sponsored Challenge does not automatically include the candidate’s unrelated personal Answerr conversations, independent Challenges, personal credentials, or records associated with another organization.
Any broader data sharing must have an appropriate legal basis and must be disclosed as required by law.
7.7 Candidate Visibility
The availability of Capability Reports to candidates may depend on the product configuration, sponsoring organization’s lawful policies and the applicable service.
However, organizational settings do not override rights to access, correct, obtain, or dispute information where those rights exist under applicable law.
Answerr may provide candidates with additional information directly when required to satisfy its own legal obligations.
7.8 Staffing and Recruitment Agencies
Authorized staffing firms, recruitment agencies and recruiting intermediaries may use Answerr to evaluate candidates for their legitimate client engagements, subject to their purchased subscription and applicable agreement.
Where permitted by the applicable subscription, such customers may share relevant Capability Reports with designated employer clients for authorized recruiting purposes.
They must not:
- Distribute reports to unrelated third parties without proper authorization.
- Make candidate data available for purposes inconsistent with the applicable disclosures, permissions, or law.
- Resell access to the Platform or create unauthorized sublicensing arrangements.
- Share a candidate’s information with additional employers without a lawful basis.
- Use reports beyond authorized purposes or applicable retention periods.
A staffing firm’s authorized sharing of reports does not by itself constitute permission to resell Answerr’s software or scoring technology.
7.9 Fair Credit Reporting Act and Similar Laws
Employment-related reports and evaluation services may be subject to consumer-reporting, employment-screening, or similar laws depending on their characteristics and use.
Nothing in these Terms establishes that any particular report or activity is or is not a consumer report under the Fair Credit Reporting Act (“FCRA”), or determines whether Answerr or another party has obligations as a consumer reporting agency.
Where the FCRA or comparable law applies, each party must fulfill its applicable obligations, including any required authorization, permitted-purpose verification, accuracy procedures, disclosures, adverse-action notices, dispute handling and recordkeeping.
Customers must not use the Service for FCRA-regulated purposes outside the expressly authorized scope of their agreement, or for other regulated eligibility decisions such as credit, insurance, or housing, without a separate written agreement and required compliance arrangements.
Answerr and the customer will coordinate any additional contractual and operational requirements necessary for a legally permitted employment-screening use.
7.10 No Employment Guarantee
A Capability Report describes observed performance within a particular evaluation context.
It does not guarantee future employment performance, predict career success, or establish a person’s general intelligence, character, or worth.
Results should be interpreted in light of the Challenge, evaluation methodology, role requirements and relevant limitations.
8. Workforce Development and Organizational Use
8.1 Organizational Capability Programs
Organizations may use Answerr to understand AI capability across employees, teams, departments, or other permitted groups.
Features may include individual Challenges, capability reporting, development recommendations, repeated evaluations and aggregate organizational insights.
8.2 Employee Notice and Transparency
Organizations are responsible for informing employees or other participants about relevant program requirements, the categories of information collected, how results may be used and who may access them.
Where consent or another lawful basis is required, the organization must establish that basis before the relevant processing begins.
Answerr must not be used to conduct unlawful or undisclosed employee surveillance.
8.3 Access to Individual and Team Results
Authorized administrators may receive individual or aggregated results according to their organization’s plan, permissions and applicable law.
Access to organizational reporting does not automatically authorize access to an individual’s unrelated personal account or private activity.
8.4 Continuous Measurement and Connected Activity
Where Answerr offers optional integrations, browser extensions, or other features that collect AI interaction data outside an ordinary Challenge, those features must operate according to their applicable notices, permissions and product configuration.
They must not be used to capture private activity without an appropriate legal basis and any required participant authorization.
The collection, visibility and retention of data from such features will be disclosed before activation.
8.5 Workforce Decisions
Organizations are responsible for employment decisions involving promotions, compensation, performance management, reassignment, disciplinary action, or termination.
Capability information must be used consistently with applicable employment and privacy laws.
Answerr does not make those decisions on behalf of the organization.
8.6 Educational Organizations
Educational institutions may use Answerr for AI capability development, instructional support, learning evaluation, governance and other authorized educational activities.
Institutions remain responsible for academic policies, grading decisions, student communications, accessibility obligations and compliance with applicable education laws.
Any specialized learning management system integration, roster synchronization, or grade transfer is subject to the applicable configuration and agreement.
9. AIQ™ Credentials and Capability Reports
9.1 Purpose of AIQ™
AIQ™ is Answerr’s credential for recognizing demonstrated capability in AI-assisted work.
Where available, credentials may document an individual’s performance, evidence, credential level, issuing framework, or other relevant attributes.
An AIQ™ credential is distinct from an employer-sponsored Capability Report.
Not every Challenge produces a credential.
9.2 Nature of Results
Capability measurement may draw on observed reasoning, verification, questioning, adaptation and other relevant behavior.
Results represent performance within the conditions of a particular evaluation.
They are not measures of innate intelligence, personal worth, fixed aptitude, or guaranteed future success.
9.3 Automated Evaluation
Answerr may use automated systems, including multiple AI models and proprietary scoring methods, to analyze permitted interaction evidence and generate Capability Reports.
Automated evaluation may be affected by incomplete information, ambiguous responses, model variability, or methodological limitations.
Where required by law, individuals may be entitled to information about automated processing, human intervention, or review procedures.
9.4 Methodology Updates
Answerr may refine its evaluation framework, dimensions, calibration, classification methods and supporting technology.
Results generated under different versions may not be directly comparable.
Where supported, reports and credentials will identify the applicable evaluation version or other relevant methodology reference.
9.5 Credential Issuance
Eligibility for an AIQ™ credential depends on applicable requirements, successful completion of qualifying activities and any integrity or verification conditions.
Credential availability, duration, benefits and verification features may differ by subscription.
9.6 Credential Sharing and Verification
Individuals may be permitted to share their credentials through Answerr-supported profiles, verification links, digital badges, or other mechanisms.
Public credential sharing is separate from a sponsoring organization’s authorized access to its Capability Reports.
Where a public verification feature requires user activation, Answerr will make the relevant sharing controls available.
Verification shows only the credential details the holder has chosen to share. No one may use Answerr’s verification features to search for, look up, or confirm a credential belonging to a person who has not shared it with them.
9.7 Suspension or Revocation
Answerr may suspend or revoke a credential where:
- It was issued due to a material error.
- Material misconduct compromised its validity.
- Identity or participation information was materially misrepresented.
- The underlying evaluation was materially defective.
- Revocation is required by law.
Affected holders will receive notice and may use the applicable appeal process.
9.8 Credential Continuity
Termination of an organization subscription does not automatically invalidate a properly issued individual credential.
Subject to applicable law and a holder’s deletion rights, Answerr will maintain verification support for previously issued credentials for at least three (3) years after the sponsoring organization’s subscription ends.
9.9 No Guaranteed Outcomes
Neither a credential nor a Capability Report guarantees employment, admission, academic credit, promotion, compensation, professional licensing, or any other outcome.
Organizations and third parties remain responsible for how they interpret and use credential information.
10. Session Monitoring, Verification and Accessibility
10.1 Optional Monitoring
Where offered, Challenge monitoring or identity-verification features may be enabled for particular sessions or organizational programs.
Camera-based monitoring and similar optional capture features are disabled by default.
No such feature should be treated as active merely because it is described in these Terms.
10.2 Advance Disclosure
Where monitoring is enabled, participants will receive information about the categories of data collected, the purpose of collection, relevant access permissions and retention arrangements before capture begins.
10.3 Consent and Other Legal Requirements
Where applicable law requires consent or another authorization for monitoring, Answerr and the sponsoring organization must ensure the applicable requirements are satisfied before the relevant collection.
Consent must not be treated as a substitute for another legal requirement that applies to the activity.
10.4 Declining Monitoring
A participant may decline an optional consent-based monitoring feature.
Declining may affect the ability to complete a particular monitored Challenge.
The sponsoring organization is responsible for determining whether an alternative is required or appropriate, subject to applicable law.
10.5 Biometric Information
Where an enabled feature processes information qualifying as biometric data under applicable law, Answerr will apply any required disclosures, authorizations, restrictions and retention or destruction procedures.
Answerr does not sell biometric information.
10.6 Retention of Session Media
Where optional session media is collected, the standard retention period is thirty (30) days unless an applicable agreement, legal requirement, or documented investigation requires a different period.
Any longer retention will be subject to applicable law and the relevant disclosures.
10.7 Automated Integrity Signals
Automated indicators may be used to identify sessions requiring review.
An automated flag alone will not be treated as a final determination of misconduct without appropriate human review.
10.8 Accessibility and Accommodations
Answerr seeks to make its Service accessible to users with disabilities.
Participants may report accessibility issues or request assistance at support@answerr.ai using “Accessibility” in the subject line.
For organization-sponsored activities, the sponsoring organization remains responsible for legally required accommodation decisions, while Answerr will provide reasonable technical cooperation for supported accommodations.
Nothing in these Terms limits rights under applicable disability and accessibility laws.
11. Artificial Intelligence Models and Outputs
11.1 Third-Party Models
Answerr uses AI systems operated by external Model Providers to run Challenges, power the AI interactions within them and help produce Capability Reports.
Inputs and relevant context may be transmitted to those providers as necessary to deliver that functionality.
Model Providers process data under the applicable contractual and technical arrangements established by Answerr.
11.2 No Training on Customer Data
Answerr does not use Customer Data to train its own general-purpose AI models.
We select Model Providers and maintain contractual arrangements intended to prevent customer content submitted through Answerr from being used to train those providers’ general-purpose models.
Provider-specific retention and security arrangements may vary and are described in our Privacy Policy or our Trust Center at https://trust.inc/org_6908e3c1fe011d5b10bca425.
11.3 Output Accuracy
Artificial intelligence systems can generate incorrect, misleading, incomplete, inconsistent, or outdated information.
Users are responsible for applying appropriate judgment and verification before relying on AI-generated Outputs.
Outputs must not replace qualified professional judgment in medical, legal, financial, safety-critical, or other regulated contexts.
11.4 Non-Exclusive Outputs
AI-generated Outputs may be similar or identical across different users.
Answerr does not guarantee that an Output is unique or free from third-party intellectual property claims.
11.5 Provider Changes
Model Providers may modify their models, interfaces, restrictions, pricing, or availability.
Answerr may change the models it uses where reasonably necessary to maintain the Service, meet legal obligations, or manage provider changes.
11.6 Provider Policies
Use of the Service may be subject to additional Model Provider restrictions communicated through the Service.
Users must comply with applicable restrictions.
12. Data Ownership, Privacy and Security
12.1 Privacy Framework
Answerr processes personal information according to its Privacy Policy, applicable customer agreements and relevant privacy laws.
Depending on the purpose and context of processing, Answerr may act as a controller, processor, business, or service provider under applicable law.
For information processed on behalf of an Organization, that organization generally determines the relevant purposes and instructions, subject to the parties’ agreement and applicable law.
12.2 Data Ownership
As between Answerr and its customers or users, the relevant customer or user retains applicable rights in information lawfully provided to the Service.
Where an individual submits material during an organization-sponsored Challenge, the individual retains applicable rights in their original content, while Answerr and the sponsoring organization receive the rights reasonably necessary to administer, evaluate, report and otherwise lawfully use the Challenge as disclosed and agreed.
Answerr retains ownership of its proprietary Platform technology, scoring methodologies, evaluation systems, Challenge Content and other protected intellectual property.
12.3 License to Process Data
You grant Answerr the limited rights necessary to host, transmit, process, analyze, secure, display and otherwise handle your data to provide the Service, comply with law and perform the activities described in these Terms and applicable privacy documentation.
This does not give Answerr ownership of your original Inputs.
12.4 Candidate and Employee Information
Information generated through employer-sponsored or workforce activities may be made available to authorized organizational personnel in accordance with the applicable configuration, agreement, participant disclosures and law.
An organization does not receive unrestricted rights to personal information merely because it purchases a subscription.
12.5 Third-Party Integrations and Data Sharing
When an Organization enables a Third-Party Integration, Answerr may transmit or receive information necessary for that integration.
This may include candidate identity, invitations, participation status, completed evaluation reports, or other authorized records.
Organizations are responsible for ensuring that their connected applications, recipients and sharing instructions are authorized.
Once information has been transferred to a third-party system operated independently of Answerr, that system’s applicable terms, security arrangements and privacy practices may also govern its subsequent handling.
12.6 No Sale of Personal Information
Answerr does not sell personal information.
Answerr does not use Customer Data for cross-context behavioral advertising or to train general-purpose AI models.
Any material change to these practices will be addressed according to applicable law and our published privacy commitments.
12.7 Aggregated and De-Identified Information
Answerr may create aggregated or de-identified information for lawful purposes including security, service improvement, benchmarking, capability research and product analytics.
Such information must not reasonably identify an individual or Organization.
Answerr will not intentionally re-identify de-identified information except where legally permitted for testing or validating de-identification safeguards.
Organizations may request exclusion from published organizational benchmarks by written notice, subject to any separate agreement.
12.8 Research
Answerr may conduct research concerning AI capability, human judgment and AI-assisted work.
Research involving identifiable Customer Data beyond ordinary Service delivery requires an appropriate legal basis and any additional agreements, approvals, or participant permissions required by law.
12.9 Data Processing Addendum
Organizations requiring additional data-processing commitments may request Answerr’s Data Processing Addendum.
Where executed, the DPA governs the parties’ respective obligations for covered personal-data processing.
12.10 Educational Records
Where an educational institution subject to the Family Educational Rights and Privacy Act (“FERPA”) authorizes Answerr to process protected education records as a qualifying school official, Answerr will process those records under the institution’s direction and applicable contractual restrictions.
Answerr will not use or disclose those records beyond the authorized educational purpose except as permitted by law and the applicable agreement.
The institution remains responsible for determining whether the applicable legal requirements and school-official conditions are satisfied.
12.11 Security Safeguards
Answerr maintains administrative, technical and organizational measures intended to protect Customer Data against unauthorized access, loss, alteration and disclosure.
These measures include appropriate access controls, encryption, logging, security policies and vendor-management practices.
Answerr maintains a SOC 2 Type II report, available to eligible customers and prospective customers under appropriate confidentiality arrangements, and holds ISO/IEC 27001 certification for its information security management system.
Additional security documentation is available through our Trust Center at https://trust.inc/org_6908e3c1fe011d5b10bca425.
12.12 Security Incidents
Where Answerr identifies a security incident affecting Customer Data, we will provide notifications required by applicable law and relevant customer agreements.
Affected organizations will receive reasonably available information concerning the incident and appropriate mitigation measures.
12.13 Data Export
Organizations may request export of available Customer Data during their subscription and for thirty (30) days after termination.
Exports will be provided in a commercially reasonable, machine-readable format, subject to applicable rights, technical limitations and legal restrictions.
12.14 Data Retention and Deletion
Answerr retains information for the periods described in the Privacy Policy, applicable agreements and any legally required retention schedules.
Following termination of an Organization’s subscription, Customer Data will generally be deleted within ninety (90) days, subject to lawful retention requirements, backup cycles, valid credential records and other agreed exceptions.
The deletion of an organization’s workspace does not automatically invalidate an individual’s independently held credential or eliminate records that must lawfully be preserved.
12.15 Privacy Rights
Individuals may have rights to access, correct, delete, restrict, or obtain copies of personal information, depending on applicable law.
Individuals participating through an Organization should ordinarily contact that organization concerning information it controls.
Answerr will assist with valid requests as required by law and applicable agreements.
Privacy requests may be sent to support@answerr.ai using “Privacy Request” in the subject line.
13. Intellectual Property and Licensing
13.1 Answerr Intellectual Property
Answerr and its licensors own the Service and associated protected technology, including:
- Platform software and interfaces.
- Proprietary Challenge Content.
- Evaluation and scoring methodologies.
- Scoring implementations and calibration systems.
- Private prompts and technical configurations.
- Proprietary analytics and reporting structures.
- Credential infrastructure.
- Software documentation and related intellectual property.
Except as expressly permitted, these Terms do not transfer ownership of Answerr intellectual property.
13.2 License to Use the Service
During the authorized subscription or access period, Answerr grants users a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and applicable purchase rights.
Organizations may make the Service available to authorized personnel and invited participants within their purchased scope.
Staffing and recruitment customers may share reports with designated employer clients where expressly permitted under Section 7 and the applicable subscription.
No general sublicensing, software resale, or redistribution right is granted.
13.3 Customer Content and Outputs
Customers and users retain their applicable rights in original Inputs and other lawfully submitted content.
To the extent Answerr holds transferable rights in AI-generated Outputs produced for a customer, Answerr assigns those rights to that customer, subject to applicable law, third-party rights and any provider restrictions.
This assignment does not transfer ownership of the Service, proprietary Challenge materials, scoring methodologies, or evaluation infrastructure.
13.4 SLPT Open Specification
The Standard Learning Provenance Taxonomy (SLPT) is published as an open specification under the licenses applicable to its released materials, including Apache License 2.0 where specified.
The licenses accompanying publicly released SLPT materials govern the right to use, implement, reproduce, or adapt those materials.
The publication of SLPT does not grant access to Answerr’s proprietary scoring implementation, confidential evaluation logic, private datasets, calibration systems, or hosted credentialing infrastructure.
Nothing in these Terms restricts rights independently granted by an applicable open-source license.
13.5 Trademarks
Answerr, AIQ™ and related logos and branding are marks used by Answer Labs Inc.
No trademark license is granted except as expressly authorized.
Credential holders may accurately identify their credentials and display officially issued badges in accordance with applicable branding and verification rules.
13.6 Feedback
If you provide suggestions, improvement ideas, or product feedback, you grant Answerr a worldwide, non-exclusive, perpetual, royalty-free right to use that feedback for lawful business purposes.
This provision does not grant Answerr ownership of personal data or unrelated confidential information submitted through the Service.
13.7 Intellectual Property Complaints
Copyright or intellectual property complaints may be submitted to support@answerr.ai using “DMCA” in the subject line.
Formal notices may also be mailed to the company address listed in Section 22.
14. Confidentiality
Each party may receive confidential business, technical, operational, or other non-public information from the other party.
The receiving party agrees to:
- Use confidential information only for purposes authorized by the agreement.
- Apply reasonable safeguards against unauthorized disclosure.
- Limit access to personnel, contractors and professional advisers who have a legitimate need to know and are subject to appropriate confidentiality obligations.
- Avoid unauthorized disclosure to third parties.
Confidential information does not include information that becomes public without breach, was lawfully known before disclosure, is independently developed without use of protected information, or is lawfully obtained from an unrestricted third party.
Disclosure required by law is permitted, provided the receiving party gives advance notice when legally allowed and reasonably cooperates with appropriate protective measures.
Proprietary Challenge Content, unpublished scoring methods and private evaluation configurations constitute Answerr confidential information regardless of whether they are specifically marked confidential.
This section does not restrict lawful whistleblowing, protected employee activity, or disclosures that cannot legally be prohibited.
15. Warranties and Disclaimers
15.1 Authority
Each party represents that it has the legal authority necessary to enter into these Terms.
15.2 Limited Service Warranty
For paid services, Answerr warrants that the Service will substantially conform to its applicable published documentation during the subscription period.
If Answerr materially breaches this warranty, the customer must provide notice and a reasonable opportunity to correct the issue.
If Answerr cannot resolve the material nonconformity within a reasonable period, the affected customer may terminate the affected service and receive a proportionate refund of prepaid fees for the unused affected period.
This remedy does not limit rights that cannot legally be excluded.
15.3 AI-Specific Limitations
AI-based Outputs, Capability Reports and credentials may involve probabilistic or automated evaluation and may contain errors or limitations.
Answerr does not guarantee that any result will be complete, unbiased in every context, accurate for every purpose, or predictive of future individual performance.
Organizations remain responsible for evaluating whether the Service is suitable for their intended use and for satisfying applicable legal requirements.
15.4 Disclaimer
EXCEPT FOR EXPRESS WARRANTIES AND RIGHTS THAT CANNOT LEGALLY BE EXCLUDED, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANSWERR DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
ANSWERR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE AT ALL TIMES, OR THAT PARTICULAR AI-GENERATED OUTPUTS, CAPABILITY REPORTS, OR CREDENTIALS WILL PRODUCE A SPECIFIC RESULT.
Nothing in this section excludes responsibilities or remedies imposed by mandatory law.
16. Limitation of Liability
16.1 Excluded Damages
To the maximum extent permitted by law, neither party will be liable to the other for indirect, special, incidental, consequential, exemplary, or punitive damages arising from these Terms, including lost profits, lost business opportunities, or loss of goodwill.
This exclusion does not apply where such damages cannot legally be excluded.
16.2 Liability Cap
Except as provided below, each party’s total aggregate liability arising out of or relating to these Terms will not exceed the greater of:
- (a) the total fees paid or payable by the customer to Answerr during the twelve (12) months preceding the event giving rise to the claim; or
- (b) one hundred U.S. dollars ($100).
16.3 Exceptions
The limitations above do not apply to the extent prohibited by law or to:
- Fraud or intentional misconduct.
- Gross negligence where liability cannot be limited.
- Payment obligations properly owed.
- Misuse or infringement of the other party’s intellectual property rights.
- Breach of confidentiality obligations.
- Indemnification obligations expressly assumed under Section 17.
- A customer’s or user’s breach of Section 5 (Acceptable Use), Section 6 (Challenge integrity), or Section 7 (Hiring, Recruiting and Staffing Use), or an Organization’s unauthorized disclosure or misuse of candidate or employee information.
Any additional liability caps or exceptions for privacy, security, data protection, or regulated employment services may be established in a signed customer agreement.
16.4 Allocation of Risk
The parties agree that these limitations reflect the allocation of risk underlying their commercial arrangement.
Nothing in these Terms limits legally protected claims or statutory remedies that cannot be waived.
17. Indemnification
17.1 Answerr Indemnification
For Organizations, Answerr will defend against third-party claims alleging that the Service, as provided by Answerr and used in accordance with the applicable agreement, infringes a United States patent, copyright, or trade secret.
Answerr will pay damages finally awarded by a court or amounts agreed in an approved settlement.
This obligation excludes claims arising from unauthorized modifications, customer-provided materials, use outside the agreed scope, or combinations with third-party products not supplied or authorized by Answerr where the claim would not otherwise have arisen.
17.2 Organization Indemnification
To the extent permitted by law, an Organization will defend and indemnify Answerr against third-party claims arising from:
- The customer’s unlawful use of the Service.
- Customer Data submitted without sufficient rights or authorization.
- Unauthorized disclosure or misuse of candidate or employee information.
- The customer’s unlawful employment or other consequential decisions.
- Material breach of applicable use restrictions.
- Violations of law attributable to the customer’s conduct.
This does not require the customer to indemnify Answerr for claims caused by Answerr’s own breach, negligence, or unlawful conduct.
Public institutions are subject to indemnification obligations only to the extent permitted by applicable law.
17.3 Individual Users
Individual Users remain responsible for their own unlawful conduct and intentional violations of these Terms, subject to applicable consumer protections.
17.4 Claim Procedure
An indemnified party must provide prompt notice of a covered claim, reasonably cooperate in its defense and permit the indemnifying party to manage the defense, subject to appropriate protections.
No settlement may impose an admission of wrongdoing or non-monetary obligation on the indemnified party without its consent.
18. Term, Suspension and Termination
18.1 Term
These Terms remain effective while you access or use the Service.
Paid subscriptions continue for their applicable billing periods unless terminated or canceled according to their terms.
18.2 Individual Cancellation
Individual Users may cancel paid subscriptions through available account controls or by contacting support@answerr.ai.
Cancellation normally takes effect at the end of the current paid period unless required otherwise by law.
18.3 Organization Termination
Organization subscription terms, renewal rights and termination procedures are governed by the applicable agreement.
Where no specific termination procedure applies, either party may terminate for material breach if the breach remains uncured thirty (30) days after written notice.
18.4 Suspension
Answerr may temporarily suspend access when reasonably necessary because of:
- Serious security threats.
- Unlawful or fraudulent activity.
- Material misuse of the Service.
- Significant Challenge integrity concerns.
- Unresolved payment defaults after appropriate notice.
- Legal or regulatory requirements.
Where practicable, Answerr will limit suspension to the affected accounts or activities and restore access after the issue is resolved.
18.5 Effects of Termination
Following termination or expiration:
- Access to affected paid features ends.
- Accrued fees remain payable.
- Applicable data export and deletion procedures take effect.
- Customers must stop unauthorized use of Answerr intellectual property.
- Any contractual provisions intended to survive termination remain effective.
18.6 Credential Continuity
Validly issued AIQ™ credentials are not automatically revoked because an organization cancels its subscription.
Continued credential verification and record handling remain subject to Section 9, applicable retention requirements and individual privacy rights.
18.7 Surviving Provisions
Provisions concerning accrued payments, data handling, intellectual property, confidentiality, warranties and disclaimers, limitation of liability, indemnification, dispute resolution and other provisions that by their nature should survive will remain effective after termination.
19. Disputes and Governing Law
19.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory law requires otherwise.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19.2 Informal Resolution
Before initiating formal proceedings, either party should contact the other to attempt a good-faith resolution.
Legal disputes may be reported to support@answerr.ai using “Legal” in the subject line.
The parties will attempt informal resolution for thirty (30) days, except where urgent relief or applicable law requires a different procedure.
19.3 Individual User Arbitration
For disputes between Answerr and an Individual User acting in a personal capacity, unresolved claims will generally be submitted to binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, to the extent enforceable under applicable law.
The parties agree to individual proceedings rather than class or representative arbitration, except where such restrictions are prohibited by law.
Nothing in this provision restricts an eligible individual claim in small claims court or prevents a party from seeking relief that cannot lawfully be subjected to arbitration.
19.4 Arbitration Opt-Out
An Individual User may opt out of the arbitration provision by emailing support@answerr.ai with “Arbitration Opt-Out” in the subject line within thirty (30) days of first accepting these Terms.
The request should identify the user’s account email and clearly state the intention to opt out.
Opting out does not affect the remaining Terms.
19.5 Organizations and Sponsored Participants
Organizations are not subject to the individual consumer arbitration provision unless expressly agreed otherwise.
Candidates, employees, students and other Authorized Users acting solely through an organization-sponsored activity are not automatically subject to the individual consumer arbitration provision.
Disputes not subject to arbitration will be brought before the competent state or federal courts in Delaware, unless mandatory law or a negotiated agreement requires another forum.
19.6 Public Institutions
Where applicable law restricts the governing law, venue, arbitration, or other dispute-resolution obligations of a public institution, those legal requirements control to the extent necessary.
20. General Provisions
20.1 Compliance with Law
Each party must comply with applicable laws and regulations relevant to its use or provision of the Service.
This includes applicable privacy, employment, intellectual property, sanctions, export control and anti-bribery laws.
20.2 International Use
Answerr operates from the United States and may use infrastructure and subprocessors in multiple jurisdictions.
Users accessing the Service internationally are responsible for complying with applicable local laws.
International personal-data transfers are governed by the Privacy Policy and any applicable Data Processing Addendum.
20.3 Accessibility
Answerr seeks to maintain accessible experiences and aims to align its product accessibility practices with recognized accessibility standards, including WCAG 2.1 Level AA.
Accessibility documentation may be requested from support@answerr.ai.
20.4 Publicity
Neither party may use the other’s trademarks, logos, or name in public promotional materials without appropriate permission, except where expressly permitted by an Order Form or another written agreement.
20.5 Subprocessors
Answerr uses third-party service providers for hosting, AI processing, applicant tracking and other integrations, communications, support, analytics, payment processing and other operational purposes.
Answerr remains responsible for its subprocessors’ performance, and subprocessor arrangements are subject to applicable agreements and data-protection obligations.
A current list naming each subprocessor is maintained in our Trust Center at https://trust.inc/org_6908e3c1fe011d5b10bca425 and is available on request.
Answerr will give Organizations at least thirty (30) days’ notice before adding a subprocessor that processes Customer Data. Organizations may object on reasonable data-protection grounds during that period.
Where an applicable DPA provides additional notice or objection rights, those provisions apply.
20.6 Force Majeure
Neither party is responsible for a failure or delay caused by events beyond its reasonable control, except that this provision does not excuse payment obligations already due.
20.7 Assignment
Neither party may transfer its contractual rights or obligations without the other’s consent, except in connection with a merger, acquisition, corporate reorganization, or sale of substantially all relevant assets, provided applicable legal and contractual requirements are satisfied.
20.8 Independent Parties
The parties are independent contractors.
These Terms do not create an employment, agency, partnership, fiduciary, franchise, or joint-venture relationship.
20.9 Notices
Answerr may provide operational or contractual notices through the registered account email, in-product notifications, or other legally permitted channels.
Formal notices to Answerr may be sent by email to support@answerr.ai with “Legal” in the subject line or by mail to the address in Section 22.
20.10 Severability
If a provision is found unenforceable, it will be limited to the extent necessary, and the remaining provisions will remain effective where legally permissible.
20.11 No Waiver
A party’s failure to enforce a provision does not waive the right to enforce it later.
20.12 Third-Party Rights
Unless expressly provided or required by law, these Terms do not create enforceable contractual rights for unrelated third parties.
This does not limit independent statutory rights held by candidates, employees, or other individuals.
20.13 Entire Agreement
These Terms, together with applicable accepted Order Forms, Master Services Agreements, Data Processing Addenda and incorporated service-specific terms, constitute the parties’ agreement concerning the Service.
They supersede earlier terms addressing the same subject matter, except where an existing signed agreement expressly remains controlling.
21. Changes to These Terms
Answerr may update these Terms to reflect product changes, legal requirements, security developments, or operational needs.
For material changes, we will generally provide at least thirty (30) days’ advance notice through email, in-product communication, or another appropriate method.
Changes required urgently by law or to address significant security risks may take effect sooner where permitted.
Updated Terms will state the new effective date.
Continued use after the effective date may constitute acceptance where legally permitted.
If a paying customer does not agree to a material change, the customer may stop using the affected Service and request any remedy available under its existing agreement or applicable law.
Changes to these Terms do not unilaterally override negotiated provisions of an active signed Master Services Agreement or Order Form.
